A man claims Roswell Police wrongfully shot him at his home.
Richard Johnson has filed a civil rights lawsuit in federal court in Albuquerque.
He says the shooting happened after a family member pistol-whipped him during a fight.
Johnson has accused the police of shooting him without identifying itself two years ago.
Court documents show he had a concussion from the fight, and then he walked two miles home with a bleeding gash.
The lawsuit claims an officer arrived at his apartment a few hours and called for him.
It also claims Johnson came to the door with a pistol, but the police shot him without telling him to drop his weapon.
The AP reports the city manager has not returned an email for comment.
